Terms & Conditions

These Terms & Conditions govern your use of our website and purchase of products from Kyosho India. By placing an order, you agree to be legally bound by these terms, including our Shipping Policy, Privacy Policy, and Copyright Policy.

A. General Acceptance

  1. Definition of Parties
    1. “Seller” refers to Hemani International Private Limited.
    2. “Buyer” refers to any individual, entity, or company intending to purchase products from the website.
  2. Agreement Confirmation
    By checking the Terms & Conditions checkbox at checkout, you confirm that:
    1. You have read and agreed to these Terms.
    2. You understand that a complete unboxing video is mandatory for return or delivery-related claims.

Important Return Notice

Returns are accepted only if:

  • Product is received damaged
  • Product has a manufacturing defect
  • Wrong item is delivered

You must email us at info@kyoshoindia.com within 24 hours of delivery, along with:

  • Complete and continuous unboxing video
  • Order details
  • Supporting images

Claims without an unboxing video will not be entertained.
Failure to report within 24 hours implies the product was delivered in proper condition.

  • Age Restriction
    Most products are intended for individuals aged 14 years or above unless otherwise stated. By placing an order, you confirm you are at least 14 years old.
  • Product Description Confirmation
    By placing an order, you confirm that you have read and understood the product description, specifications, size, and condition details.

B. Acceptance of Order

  1. Order confirmation email does not constitute a binding contract.
  2. A contract is formed only after successful receipt of full payment.
  3. Kyosho India reserves the right to cancel any order at its sole discretion.
  4. Refunds (if applicable) will be processed within 8–15 bank working days to the original payment method.

Threats, defamatory statements, or attempts to damage the brand reputation may result in legal proceedings under applicable Indian law.

C. Prices & Billing

  1. Product Price / MRP
    Displayed prices include applicable taxes unless stated otherwise.
  2. Pricing Above MRP
    Any amount above MRP may represent special packaging, handling, or logistics charges.
  3. Pre-Order Pricing
    Pre-order prices may change due to import costs, duties, or availability. Customers will be notified of any revisions.
  4. Zero-Value Listings
    Any product listed at ₹0 indicates a technical error or internal testing listing. Such orders will be automatically cancelled.
  5. Invoice Disclaimer
    Automated checkout invoices are provisional.
    The final tax invoice issued at dispatch shall be considered legally valid.
  6. Right to Modify Prices
    Kyosho India reserves the right to modify prices at any time without prior notice.

D. Packaging Disclaimer

  1. Outer packaging, acrylic cases, or protective covers are not guaranteed unless specifically stated.
  2. Minor scratches or cosmetic packaging imperfections are not eligible for return.
  3. Buyers acknowledge transit risks once shipment is dispatched.

E. Shipping & Delivery

  1. Delivery will be made to the address provided at checkout.
  2. Address or contact details cannot be changed after dispatch.
  3. If delivery fails due to incorrect details or refusal, re-shipping charges + insurance (approx. 2–5%) will apply.
  4. Delivery timelines are estimates and not guaranteed.
  5. Risk transfers to the buyer upon successful delivery.

F. International Orders

International orders may be subject to additional duties, taxes, and shipping charges.

G. Pre-Order Policy

  1. Delivery timelines are approximate and may change.
  2. Pre-orders cannot be cancelled.
  3. No refunds for pre-orders unless cancelled by Kyosho India.
  4. Kyosho India reserves the right to cancel pre-orders due to stock or production issues.

H. Legal Action & Misconduct

  1. Threats, defamation, abusive communication, or false allegations may result in legal action.
  2. False chargebacks will be treated as financial misconduct.
  3. Kyosho India reserves the right to refuse service to any customer violating policies.
  4. Unauthorized third-party interference in disputes will not be entertained.

I. Resolution Timeline

Dispute investigations may take 7 to 45 working days depending on the complexity of the case.

J. Communication Policy

  • All disputes must be communicated via registered email only.
  • Include Order ID in subject line.
  • Provide complete details and supporting media.
  • Communication from unregistered emails may not be entertained.

K. Resale & Price Manipulation Policy

  1. Products are for personal collection only.
  2. Unauthorized resale without written approval is prohibited.
  3. Maximum purchase limit: 2 units per model.
  4. Violations may result in blacklisting and legal action under Indian law.

L. Intellectual Property

All website content, including text, images, logos, and product listings, is the property of Kyosho India and protected under Indian copyright and intellectual property laws. Unauthorized use is strictly prohibited.

M. Limitation of Liability

To the fullest extent permitted by law, Kyosho India shall not be liable for indirect, incidental, or consequential damages arising from product use or services.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. All disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
